Following
are the conditions and requirements of service performance:
1. Conditions and requirements of licensing for the production of various seed classes of agricultural crops specified by Ministry of Agriculture:-
- Stated as a condition that produced seeds must
be of agricultural crops (Field Crops, Vegetable crops…) which is adopted by the Ministry of
Agriculture.
- An application for licensing for seed
production should be submitted to CASC, on the specific application, includes
(the name of Company - the name of Director in charge)
- The application attachment includes the
following documents that indicating the availability of the required
infra-structure which suits the size, type and methodologies of the licensing
seed production as production fields, storage facilities, cold stores,
processing plants.
- Copy of the tax card shows the activity (seed
production).
- Copy of the commercial register includes the
number and the date that shows the activity (seed production).
- The payment of the licensing and inspection
fees.
- The establishment of internal quality control
system
- The availability of a technical staff adequate
for the size and type of licensed production
- The
Director of the company must be
an agronomist and union member with experience not less than five years in the
field of seed production.
- The responsible director shall be responsible
to fulfill all the obligations of the Designated Authority (CASC) relating to
the requirements of production.
- The licensee should apply to CASC for seed
production for each variety seed class intended to be produced one month before the due time of planting the
crop, and for the payment of inspection fees.
- Application
of field inspection and certification of seed production field should accompany
the application.
- Adhering
to the technical requirements drown up by the management (CASC) and the
requirements included in the ministerial decree no. 1550 for 1994 and its
amendments regarding the inspection of fields production to
ensure their validity and conformity with the conditions and standards of seed
production, the decree no.38 for 1997 and its amendments concerning the procedures
and the conditions of seed certification, handling, trading, importation,
preparation, and storage.
- The
license shall be valid for five years, a yearly inspection shall be conducted
free of charge.
2. Conditions and requirements for certification for local
and imported agricultural crop seeds in order to licensing for handling,
trading and certifying for exportation:
- An
application for seed certification.
- Payment
of established fees.
- Seed
varieties of agricultural crops are certified through the administration in
accordance with the specifications and standards of acceptance specified by the
law no. 53 for 1966 and its Ministerial decrees.
- Post
Control Plots procedures.
- CASC
should make available the certification forms and seed certification labels for
each seed class against the payment of the cost of issuing such labels, the
seed certification labels are given to the licensed seed conditioning plants
after conforming the results of each field of inspection, control plots, and
testing laboratory, followed by the issuance of the international certificate
in the case of exporting seeds lot and the issuance of OECD certificate is upon
request.
- Entering
the code number on the seed certification labels in accordance with the rules
set by the administration.
- Must
take into consideration the specified requirement in seed propagation set by
the administration.
3. Conditions of obtaining the trade license:
An application should be submitted to CASC on the prescribed form, the
attachment documents of the application form are the following:
· A
copy of the commercial record, stating seed trade activities
· A
copy of tax record of the license.
· The
company establishment contract and the name and authority of the responsible
director of such company
· Renting
or ownership contract for the licensed place
· A
copy of performing commercial or industrial activities as for seed trading and
storage
· A
written statement from the applicant not to trade in any other material but
seeds under the provision of the Law No. 53 of 1966.
· A
copy of the personal identification card of the license owner and a copy of
personal identification card of the director in charge who must be an
agronomist.
· A
committee from CASC set the croaky and the inspection minutes.
· The
receipt of the payment of the established fees.
· The
license is valid for five years
· The licensed trader should maintain in the
licensed place two registers, one to show all seed quantities to be trade and
the second to show seed sales. For each seed sold, the trader should provide an
invoice in two copies, one for the purchaser and the second to be kept in the
shop.
A- General conditions for importing seeds
It is prohibited to license for importing unregistered
variety seeds. It may be permitted for scientific or research firms or for
private use to import unregistered seeds for scientific purposes or breeding
new varieties within the quantities and measures prescribed by the Agricultural
Crop Seed Committee. This should be valid for the private use, which should be
supervised by the Designated Authority. The product of such cultivation should
not be used unless the said variety should be registered and seed should be
certified according to the provisions of the Decrees, an
application form for the licensing of imported seeds is submitted to CASC, The
submitted application should include the following:
· The
seed-importing license.
· Registration
number in the Register of importers.
· A
copy from the valid seed trade license.
· The
seed quality, kind, variety, seed class requested for importing.
· A
copy from the Agriculture Crop Seeds Committee importing license.
· A
copy from the initial invoice confirmed from the Committee.
· A
copy from the final invoice.
· A
copy from the bill of lading.
· A
copy from the weighting list.
· A
copy from the packing list.
· International seed testing certificate or a
testing certificate issued from an official inspection station abroad including
the variety, the degree of purity and the germination
percentage and seed grasses and its type.
· OECD
certificate if the seeds are imported from one of OECD countries.
· If
the said seed shipment meets the lab testing national standards The Designated
Authority issued a permission of customs clearance.
B- General conditions for
exporting seeds:
It is prohibited to export any agricultural crop seeds without obtaining
the proper license from the Agricultural Crop Seeds Committee, except for the
following crops:
Flax - Castorbean-Melon - Swiss chard – Cabbage – Cawlflower -Turnip- Roquette – Radish
– Leek - Jew’s mallow – Lettuce - Spinach-Endive – Chickory - Common Purslane -
Egyptian mallow Okra – Celery – Parsley – Dill – Anise – Cumin – Fennel Coriander.
It is prohibited to license for exporting seed without obtaining the
proper license as seed trader, the application should be submitted to the
concerned Authority including:
1. The
seed exporting license.
2. Registration
number in the register of exporters.
3. A
copy from a valid seed trade license.
The shipment should be packed in new and uniform package and from material
could tolerate storage and transportation conditions. It should be written on
the packages with clear Arab littering and one of the foreign languages:
1. Seed
kind and variety after the word seed.
2. Gross
and net weight.
3. Lot
No.
4. Country
of production (Arab Republic of Egypt).
5. The
name of exporter and his trade mark if there is.
In case of small packages, stickers should be used with the same
information.
CASC may issue the Seed Testing International Certificate against the
payment of the issuance fees.
· Submitting
an application for seed testing accompanied by the seed sample identifying the kind of lab testing.
· Payment
of the established fees according to the concerned decrees.
· Receiving
of the testing results.
In case of exporting the seed lot CASC issued the ISTA certificate
against the payment of the issuance fees

Procedures & Conditions of licensing of Seed conditioning Plant.
· Submitting
an application to CASC on the related form assigned for that purpose, with the
following attachment:
· –
Company’s contract.
· Property
or lease contract for the land that the plant is constructed on.
· Tax
card declaring the activity (seed conditioning).
· The
commercial record demonstrating the activity (seed conditioning).
· Construction
licence from the competent authority according to the Industrial and trade
stores Law no. 453 year 1954.
· Provide
a detailed certified geometric design of the station including all its
contents.
· The
identification card of the director in charge and his personal information (he
must be an agronomist).
· The
obtainment of the operating license according to the Industrial and trade
stores Law no. 453 year 1954.
· Pledged
to provide the implementation of all technical requirements specified by the
Ministry of Agriculture.
· Inspection is done by the administration to
verify that they satisfy the technical
requirements identified which are
located on the website of the administration :
– License
is issued for a year after the payment of the fees assessed and it may renewed
by the same licensing procedures that had been followed previously.
7. - Procedures
& Conditions of licensing of licensing of Cotton seed Gin.
Application
should be submitted on the prescribed form with the following attachments:
· Renting or ownership contract for the licensed place.
· A copy of tax record of the license stating the activity
cotton ginning.
· A copy of the commercial record, stating cotton
ginning activities
· The permeation of ministry of environment.
· Construction permit, from the designated authority in
accordance with the law of commercial and industrial shops No. 453 for 1954.
· The responsible director should be syndicated as
agriculture engineer.
· The responsible director shall be responsible to fulfill
all the obligations and conditions defined by the ministry of agriculture
· Inspection is done by the administration to verify that
they satisfy the technical requirements

8. - Procedures & Conditions of licensing of Cotton seed oil-extracting millsThe application should be submitted on the
prescribed form following attachments:
· Renting or ownership contract for the licensed place.
· A copy of tax record of the license stating the activity
cotton seed oil extracting mill
· A copy of the commercial record, stating cotton seed oil
extracting mill
· Approval of establishment of cotton oil-extracting mill
or approval of the General Authority for Investment If the cotton oil-extracting mill located in one
of the new cities
· Construction permit, from the designated authority in
accordance with the law of commercial and industrial shops No. 453 for 1954.
· A certified engineering drawing.
· The responsible director should be syndicated as
agriculture engineer.
· The responsible director shall be responsible to fulfill
all the obligations and conditions defined by the ministry of agriculture
Inspection is done by
the administration to verify that they satisfy the technical requirements

9. - Procedures & Conditions of
licensing Tissue culture lab
- Application should be submitted on the prescribed form
with the following attachments:
· Renting or ownership contract for the licensed place.
· The seed-production, trade license.
· A copy of tax record of the license stating the activity
tissue culture
· A copy of the commercial record, stating the activity
tissue culture
· Construction permit, from the designated authority in
accordance with the law of commercial and industrial shops No. 453 for 1954.
· A certified engineering drawing.
· The responsible director should be syndicated as
agriculture engineer.
· The responsible director shall be responsible to fulfill
all the obligations and conditions defined by the ministry of agriculture
· Inspection is done by the administration to verify that
they satisfy the technical requirements

- Procedures & Conditions of licensing potato seed storing refrigerators
-Application should be submitted on the prescribed form with
the following attachments:
· Company establishment contract
· Renting or ownership contract for the licensed place.
· A copy of tax record of the license stating the activity

· A copy of the commercial record, stating the activity
potato seed refrigerator
· Construction permit, from the designated authority in
accordance with the law of commercial and industrial shops No. 453 for 1954.
· A certified engineering drawing.
· The responsible director should be syndicated as
agriculture engineer.
· The responsible director shall be responsible to fulfill
all the obligations and conditions defined by the ministry of agriculture

variety protection certificate
· Application should be submitted on the prescribed.
· Review applications and decide on the basis of the
availability of conditions for granting protection.
· Technical review of the questionnaire and the proposed
name of the variety and decide.
· The payment of granting variety protection.
· Delivery of a representative sample of the variety in
a timely manner and for the period of assessments to test the variety and
payment of administration fees for the test
· Received the test results the first year and received
the final results of the variety testing.
· If results were positive, protection granted and
certificate granting the right of new variety protection issued after the
fulfillment of the conditions.
· period of the granting of a new variety protection
right in accordance with the rules,

· Received requests for appeals and Alaataradat whether
there is a need.
The
legislations that control the services performances:-
- Law of agriculture no.53 for the year 1966 and its
amendments and implemented ministerial
decree.
- Law of Minister of Agriculture and Land Reclamation
no.38 for the year 1997 and its amendments of the ministerial decree no.3034
for the year 2004 on conditions and procedures of seed certification for
agricultural crops, its circulation ,its importation ,its exportation ,its
preparation its storages and use it to trade.
- Law of Minister of Agriculture and Land Reclamation
no.1550 for the year 1994 and its amendments on conditions, procedures and the
standards of field inspection.
- Law of Minister of Agriculture and Land Reclamation
no.368 for the year 1998 and its amendments on condition, procedures and the
standards of lab testing.
- Law of Minister of Agriculture and Land Reclamation
no.904 for the year 2008 on the conditions of labs licensing of tissues
cultivation, and procedures of certified seedlings production.
- The law no.82 for the year 2002 of the rights of
intellectual property, new plant variety protection, the executive regulation and
its implemented ministerial decree.
